4. Czy z podobną sytuacją spotkaliście się działając w innych krajach?
Fortuna oferuje zakłady w kolekturach w Polsce, Czechach i Słowacji, a w tych dwóch ostatnich krajach – także za pośrednictwem internetu. Muszę przyznać, że warunki prowadzenia działalności w Czechach i na Słowacji są o wiele bardziej liberalne i przyjazne dla legalnych operatorów. Przykładowo, w Czechach dopuszczalne jest przyjmowanie zakładów w Internecie, pod warunkiem, że pełnoletniość uczestnika zostanie wcześniej zweryfikowana w placówce operatora. Dzięki temu zapisowi ustawy działalność zagranicznych firm oferujących zakłady on-line, a nie posiadających sieci kolektur w Czechach jest znacznie ograniczona. Kolejną istotną różnicą jest to, że zamiast podatku czescy bukmacherzy zobligowani są przekazywać od 6% do 20% na cele społeczne, a konkretna stawka zależy od poziomu dochodu danego operatora. Brak typowego podatku od zakładów powoduje, że legalni krajowi operatorzy w Czechach są w stanie konkurować z operatorami zagranicznymi i zapewniać klientom bardzo atrakcyjną ofertę.
Z kolei na Słowacji obowiązuje dużo niższy niż w Polsce podatek – w wysokości 5% od sumy wpłaconych stawek. Dzięki temu, możliwość konkurowania z nielegalnymi bukmacherami jest większa niż w Polsce.
Do najbardziej liberalnych w Europie przepisów należą te obowiązujące w Wielkiej Brytanii, gdzie samo zawieranie zakładów nie jest tam opodatkowane, a operatorzy płacą 15% podatek od zysku brutto, w przeciwieństwie do Polski, gdzie podatek płacony jest od sumy wpłaconych stawek.
Mimo trudniejszych warunków działalności, w porównaniu do Czech i Słowacji, polski rynek jest dla nas ważny. Chcemy tu działań w pełni legalnie i oferować naszym klientom możliwie najciekawszą i najszerszą ofertę zakładów.

Tym razem news z naziemnego rynku, ale bardzo ciekawy więc wklejam. W Czechach też mają niezły bałagan z legalizacją automatów (VLT - videomatów) do gier:
Czech Republic politicians are furiously backpedaling after the lower house of parliament ‘mistakenly’ passed legislation this month that handed video lottery terminal (VLT) operators a CZK 2b (€77.7m) tax break. The Chamber of Deputies surprised the government by voting for a bill that called for a 20% tax on VLT revenue to be split into three parts: one third going to local municipalities, another third to education, while the final third was left up to the gambling companies to donate to a charity of their own choosing. (The government had sought to split the revenue evenly between municipalities and education.) Even more controversially, the deputies removed wording in the bill that levied taxes on individual machines, leaving operators responsible for paying tax only on each central server (to which hundreds of VLTs may be connected). However, the ensuing media firestorm – in which it was suggested that VLT operators had said ‘jump’ and spineless politicians had asked ‘how high’ – means the government is now hoping to make amendments (and amends) in the Senate by January.

The Economist pokusił się o policzenie, ile przeciętnie na hazard wydają mieszkańcy wybranych państw świata. Bezapelacyjne pierwsze miejsce przypadło Australijczykom.
Wydawać by się mogło, żę w tym zestawieniu królować będą Amerykanie (Las Vegas) czy Chińczycy (Makau). Otóż nie. Najwięcej na gry hazardowe w zeszłym roku wydali, licząc przeciętnie na mieszkańca w wieku powyżej 17 lat, Australijczycy! Wyszło po prawie 1300 dolarów na głowę.
Drugą pozycję zajmują obywatele Singapuru (niecałe 1200 dolarów), trzeci na podium są Irlandczycy z niecałymi sześciuset dolarami. Dalej są Kanadyjczycy, Finowie i Włosi. Dopiero na siódmej pozycji ulokowali się mieszkańcy Hong Kongu, którzy do Makau mają najbliżej.
Amerykanie ze swoimi świątyniami hazardu są dopiero na miejscu trzynastym, z marnymi 400 dolarami na głowę.

SZWECJA
Sweden is unlikely to regulate its online gambling industry until 2014 at the earliest. Consumer power and social issues are thought to be two of the stickiest points with another key quarrel over how the government will be able to ban unregulated sites. The current government’s term finishes in 2014 and MP Gustaf Hoffstedt told eGR: “I understand there may be a possibility of a licensed system being introduced at the very end of this period in the parliament in 2014, but I think it is probably more realistic to speak about regulation happening under the next government from 2014-15.”
Until 2014, Swedes will continue to gamble with the added benefit that they’ll be able to do so through the international gaming industry firms that can offer a better service.

The Danish Gambling Authority (DGA) will allow operators from any jurisdiction to apply for licenses ahead of the market opening early next year. The news, reported by eGR, means that operators based outside of locations with which Denmark signed a memorandum of understanding (Alderney and Isle of Man) will be granted a license. The rules state as long as “the licence holder can give the DGA access to perform an adequate control of the gambling system by the means of remote access or similar,” then it will be eligible for a license. The deal with the Isle of Man was signed just last week and DGA director Birgitte Sand expects the regulator to sign a similar agreement with another jurisdiction in the coming days. In addition, the regulator has encouraged anyone interested in a license to attend a hearing on December 20 in Copenhagen where a number of issues will be discussed.

The UK Treasury’s review into the estimated £1.7billion market will finish in the next couple of weeks and could approve changes that would mean a bigger tax yield for the country. The most drastic alternative was proposed by Tory MP Matthew Hancock and would involve taking tax from where a bet is placed and not using the physical location of the company. It means companies that decided to buy up a money-saving sun-haven are up shit creek with the only paddle available in the shape of a UK Gambling Commission license. An Independent article quotes the Deloitte report as saying “a 15 per cent tax could mean two-fifths of legitimate firms leaving the UK market.”

Betfair has added its name to the long list of companies and industry associations opposed to Germany’s proposed new gambling laws. The Gibraltar-based, UK-listed betting exchange formally submitted its bunched-up panties to the European Commission in Brussels on Wednesday. Betfair says the new draft treaty agreed upon by 15 of Germany’s 16 lander (states) doesn’t go far enough to eliminate the traditional favoritism afforded to certain state-run operations under the previous scheme. Chief legal and regulatory officer Martin Cruddace told the Financial Times that the “salient points of the European Commission’s detailed opinion have as of yet not been addressed … under these current proposals Germany’s new state treaty will be out of line and out of touch with fundamental EU law.”
Germany’s 15 lander are undaunted by such criticism, employing the usual ‘protectionism protects our helpless citizenry from predators’ schtick to get around the EU’s supposed free market sensibilities. Germany expects/hopes to get Brussels’ blessing on their new treaty so that the individual state leaderships can sign off on the deal by Dec. 15. Meanwhile, the renegade state of Schleswig-Holstein is proceeding apace with its own online gambling plans, featuring terms infinitely more preferable by the gambling outfits than those offered by the other 15 states.

After news last month that Europe’s Remote Gambling Association (RGA) wasn’t best pleased when the Greek government unveiled its new gambling law – reports today reveal that online gambling companies have filed a complaint with European Union regulators.
In the complaint, the European Gaming and Betting Association (EGBA) – a group which represents Unibet Group Plc and Bwin.Party Digital Entertainment – asked for the Greek government to change to the revenue-raising law because it obstructs betting firms from starting up their services in the country.
In a report by Bloomsberg, the EGBA, as well as the RGA, said they asked the European Commission to “address as a matter of urgency Greek measures that require new operators to be based in the country and handle financial transactions with Greek banks”.
The new law, which requires all online gambling organisations to pay a 30% gross profit tax on gambling products, has put Greek taxation on online gambling much higher than many other countries in the EU. The legislation effectively places the largest gambling association in Greece – OPAP – in an advantageous position in terms of taxation as they are exempt from the 30% gross profit tax. Serbia has adopted new gambling industry laws that will attempt to combat widespread money laundering. Regulation will, according to Serbian Gaming Board director Aleksandar Vulovic, “control online gaming”, “allow electronic monitoring of operators”, and “streamline taxation of the industry.” Details are sparse with one of the few details that licenses will be for a 10-year period. The Serbian government is seeking better regulation of their market with unregulated firms outnumbering others by two-to-one. Trade association JAKTA is backing the new regulations, president Mirjana Acimovic adding: “In our opinion, the most important aspect of this new law is that the Serbian government has decided to strengthen its Gaming Board and to assist it in every way.”

One of the men indicted in April as part of the federal case against online poker sites PokerStars.com, AbsolutePoker.com and FullTiltPoker.com has pleaded guilty in a New York courtroom to charges of conspiracy.
Brent Buckley was the co-founder of Costa Rica-based AbsolutePoker.com and entered his plea in US District Court in Manhattan on Tuesday after admitting that he was aware that he was breaking the law by arranging for American banks to process gambling proceeds.
The 31-year-old was charged in addition to eleven others with violating US laws prohibiting online gambling in the ‘Black Friday’ case filed on April 15 by Preet Bharara, United States Attorney for the Southern District of New York, and Janice Fedarcyk, Assistant-Director-In-Charge for the New York Field Office of the Federal Bureau of Investigation and he has now become the second to plead guilty after Bradley Franzen admitted charges of conspiracy to commit bank fraud, accepting funds in connection with unlawful gambling online and money laundering in May.
Buckley was described in court as Payments Director for AbsolutePoker.com and will next face a sentencing hearing on April 19.
“I knew that it was illegal to deceive the banks,” Buckley told Magistrate Judge Ronald Ellis in a plea deal that calls for him to receive a sentence of between a year and a year and a half in prison.
According to a report from the Associated Press news service, Buckley stated that his crime began in the autumn of 2006 and continued until last spring. Prosecutors announced a deal in May that enabled AbsolutePoker.com to return funds owed to its US-based players after the site’s games had been interrupted by the criminal prosecution.

Nie będzie zakazu dla pokera online na Słowacji
21.12.2011 Rząd Słowacji zatwierdził zniesienie projektu ustawy dotyczącej gier hazardowych, który zakładał blokowanie przez dostawców internetowych niektórych stron internetowych, w tym również serwisów hazardowych.
Projekt zakładał, że dostawcy internetowi mieliby blokować strony internetowe, które miały się znaleźć na liście stworzonej przez Urząd Skarbowy w Bratysławie. Głosowanie nad projektem odbyło się w poniedziałek.
Wniosek przeciwko ustawie został zainicjowany przez Stowarzyszenie Otwartych Technologii Informacyjnych, które we wrześniu rozpoczęło debatę na temat cenzury internetu. Wniosek ten w ciągu kilku dni został podpisany przez ponad dwa tysiące mieszkańców Słowacji i złożony w Rządzie.
Do zniesienia projektu ustawy przyczyniło się również negatywne stanowisko Komisji Unii Europejskiej w sprawie projektu ustawy hazardowej oraz sprzeciw Europejskiego Trybunału Sprawiedliwości w sprawie blokowania stron internetowych, jako walki z piractwem internetowym.

Stany Zjednoczone, przeciwnie niż Polska, zezwolą na hazard w internecie? Chcą zebrać z tego więcej podatków. U nas poprzedni rząd tego samego premiera Tuska zabronił hazardu w internecie pozbawiając kraj większych wpływów z podatków. Nie wiadomo jeszcze jakie dokładnie formy e-hazardu będą w USA legalne?
W ostatnich latach władze USA zwalczały z całą mocą hazard w internecie, w tym bardzo popularny poker. Kryzys spowodował jednak, że prezydent Obama przestał obrażać się na miliardy dolarów, które są do wzięcia z sieci. Ministerstwo sprawiedliwości wydało nową interpretację ustawy z 1961 roku, która regulowała kwestie hazardu uprawianego za pomocą łączy telekomunikacyjnych z przekraczaniem granic stanów i kraju. Wcześniej na hazard w internecie zezwoliły w ograniczonej formie stany Nevada (Las Vegas, Reno, Jezioro Tahoe) i Dystrykt Kolumbia (stołeczny). Teraz 50 pozostałych stanów może utworzyć np. internetowe loterie, które będą zgodne z prawem.
Światowy rynek internetowego hazardu w zeszłym roku wzrósł o 12 proc. do 30 mld dolarów (być może nawet do 100 mld dolarów). Jeszcze w kwietniu tego roku władze federalne USA oskarżyły trzy portale internetowe - Full Tilt Poker, Absolute Poker oraz PokerStars - o pranie brudnych pieniędzy i złamanie innych przepisów. Teraz byt przekształcił świadomość i niedawne złodziejstwo jest dobrodziejstwem dla budżetu.

The Remote Gambling Association (RGA) trade group has praised what it called ‘some of the more progressive elements’ contained in yesterday’s ruling from the European Parliament on online gambling, saying the resolution demonstrated ‘a clear shift in understanding and support for the European licensed online gambling sector’.
“In particular, it presses the European Commission to ensure compliance with European Union law and to pursue infringement proceedings against member states that unjustifiably restrict access to their gambling markets,” read a statement from the RGA.
The European Parliament’s resolution follows the publication of a ‘green paper’ concerning online gambling earlier this year by the European Commission and promotes the provision of well-regulated online gambling services, cooperation between national regulators and the need to avoid unnecessary licensing duplication and administrative burdens. In addition, the ruling noted that licensed betting operators help protect the integrity of sport and found that more progress should be made on addressing infringement cases and violations of European Union law.
“The European Parliament’s resolution demonstrates a marked change in approach,” said Clive Hawkswood, Chief Executive Officer for the RGA.
“It now wants to regulate rather than prohibit and it is pressing the European Commission to act against member states that unjustifiably restrict access to their gambling markets. The resolution is clear, reminding the European Commission of its duty to act swiftly upon receipt of complaints about violations of the freedoms enshrined in the treaties. The licensed private remote gambling sector is in full support of those remarks.”
Hawkswood also acknowledged that the licensed private remote gambling sector had already been working to deliver European-wide standards as promoted by the European Parliament’s resolution through, most notably, the Responsible Remote Gambling Measures agreed with the European Committee for Standardisation.
“The Parliament’s resolution insists that licensing procedures must be transparent and non-discriminatory and avoid unnecessary duplication of requirements and controls carried out in member states,” said Hawkswood.
“There is no evidence that introducing a well-regulated licensing regime with multiple operators presents any more concerns than a monopoly. It is clear that member states are increasingly coming to that conclusion.
“There has been a welcome advance in understanding of the licensed remote gambling sector by many MEPs and recognition of the important economic role it plays in stimulating growth and innovation. Fundamentally, however, we should remember that this is a non-legislative process. The next steps in relation to the Parliament’s resolution and the European Commission’s deliberations regarding its ‘green paper’ exercise are unclear. In the meantime, we will continue to work with receptive and forward thinking member states and to press the European Commission to enforce European Union law.”

W związku z kolejną nowelizacją prawa dotyczącego hazardu on-line, rząd francuski wydał dekret, który nakazuje dostawcom usług internetowych jeszcze skuteczniej blokować strony, które nie otrzymały licencji na prowadzenie biznesu. Nakaz francuski stanowi, że dostawcy usług internetowych muszą zapobiegać graniu przez Francuzów na stronach, które znalazły się na ,,czarnej liście”. Dostawcy muszą filtrować ruch w sieci, żadne koszty z tym związane nie będą im zwrócone.
Działania te są podobne do tych które niedawno podjął rząd belgijski. Tamtejsze władze wydały licencje jedynie trzem pokeroomom.
Pomimo iż rozwiązanie to było krytykowane, a niektórzy twierdzą, że narusza to prawo Unii Europejskiej, nie powstrzymało to rządów w kilku krajach przed wprowadzeniem takich obostrzeń.
Zarówno Belgia jak i Francja już wprowadziły takie przepisy. W Hiszpanii jest na razie projekt zawierający podobne regulacje. Niemiecki projekt został odrzucony przez Unię Europejską. Czy podobnie będzie z francuskim, okaże się niebawem.

@antekx miał chyba rację, że w Szwecji prawo hazardowe jest nieszczelne. Według moich informacji reklama bukmacherów internetowych nie jest tam dozwolona a tu proszę! Oglądał właśnie Arsenal - Leeds na szwedzkim ViaSat Football i w przerwie reklamy Unibet i Bet365, a w trakcie meczu normalnie wyświetlają kursy livebetting:

Byłem kilka tyg. temu we Fracji i taka blokada w praktyce wygląda tak:
Djsosna możesz przybliżyć jak to wygląda dokładnie z innymi bukami? ( najbardziej chodzi mi o bet365, 188bet i pinnacle).
Dwa lata temu jak byłem w Paryżu śmigały chyba wszystkie, teraz wybieram się w góry do Francji w tą sobotę i nie chciałbym, aby czekała na mnie taka niespodzianka.

Powiem tak: nie spodziewaj się zbyt wiele. Nie sprawdzaiłem 188bet i pinnacle, ale bet365 raczej również blokada. Co najgorsze, te blokady we Francji są nakładane przez dostawę Internetu, więc ciężko je obejść

Jak byłem ostatnio we Włoszech to strony bet365.com nie można było otworzyć ale znalazłem w wyszukiwarce bet365 Itally i już nie było problemu.
Strona niczym nie różniła się od normalnej, obstawiałem ze swojego konta.

LES MENUIRES . Ciekaw jestem jak to działa z 3g w telefonie z kartą sim francuską...? Z tego co wiem 3g z kartą sim poza granicami kraju swojego operatora to drogi koszt, ale nigdy nie próbowałem.

Panowie, wystarczy we Francji uzyc programu HIDE - IP, tego akurat czasami uzywam w USA i wtedy wszytsko dziala, bo zmieniamy Ip na na pryklad brytyjskie.
W wersji free mamy do wyboru tylko brytjskie i amerykanskie IP, ale jak jest wersja pelna to IP do wyboru do koloru.
Polecam, wtedy jestesmy wolni gdziekolwiek pojedziemy.

Znakomita informacja dla fanów pokera w Brazylii, ale także i na całym świecie. Decyzją brazylijskiego ministerstwa sportu, poker został oficjalnie uznany za dyscyplinę sportu.
Decyzja ta jest w dużej mierze zasługą Brazilian Conferederação Texas Hold’em (CBTH), która lobbowała i pracowała na rzecz pokera. We współpracy z International Federation of Poker (IFP) oraz International Mind Sports Association (IMSA) CBTH przekonywała brazylijskie władze do swoich racji.
W końcu się udało i poker został uznany za dyscyplinę sportową jak każda inna, a CBTH został oficjalnym związkiem sportowym odpowiedzialnym za organizację rozgrywek. Na stronie ministerstwa można znaleźć pokera na liście sportów z informacją, że jest to gra oparta na rywalizacji, wymaga treningu i rozwoju umiejętności zarówno intelektualnych jak i psychologicznych.
Ministerstwo na swojej stronie pisze też o CBTH "Dzięki ciągłej i profesjonalnej pracy na rzecz pokera organizacja ta zyskała szacunek, a poker jest postrzegany jako interesująca gra wymagająca koncentracji, treningu i nauki".
International Federation of Poker (IFP) w informacji prasowej napisała "Informacja o uznaniu pokera za sport nie mogła przyjść w lepszym momencie. Zaledwie kilka tygodni przez finałem Brazilian Poker Tour, w czasie przygotowań do piłkarskich mistrzostw świata w 2014 i Igrzysk Olimpijskich w 2016 rozwój pokera w tym szalonym na punkcie sportu kraju jest pewny

No siemanko ja wczoraj założyłem
Z tego co zdążyłem się zorientować to obsługa jest w porządku, kasa szybko na koncie. Panel łatwy w obsłudze.
Jedyny mankament jaki jak na razie zauważyłem to nie za bogata oferta meczowa.
Dzisiaj podawano na forum różne typy m.in słynne "kalju" no a w fortunie chyba nawet nie słyszeli o tym klubie.
Słaba oferta hokejowa wg nie oczywiście.
Poza tym raczej ok. Aha no i ten podatek który jednak się odczuwa

A jak wygląda sytuacja od strony prawnej ?
Np. Fortuna nie będzie wysyłała moich danych,informacji o moim koncie a tym samym będę w ten sposób w pewnym stopniu inwigilowany ?
Skoro zaistnieje takie ryzyko to raczej nie zdecyduję się na założenie tam konta.

888, Everest, Chilipoker and Titan Blacklisted in Belgium
The Belgium government has blacklisted online gambling firms 888, Everest, Chilipoker and Titan as part of its new regulatory policy.
The four largest internet service providers in Belgium are expected to prevent customers from accessing domain names on the list either through DNS or IP blocking, according to PokerFuse.com.
It also appears that PartyPoker has had a change of heart as it applies to Belgium )a population estimated between 10 and 11 million).

One notable exception on both the white and blacklist are any bwin.party domains, whose PartyPoker online poker room is the second largest internationally and runs regulated online poker rooms in France and Italy. Although the company had previously stated publicly that it felt the Belgian gaming regulation was contrary to EU law, it recently announced that it would too be applying for a license and was hopefully it would be in the first wave of licenses granted.
PokerStars received the first license on Wednesday (February 8, 2012).

Francja, Włochy, Estonia, Belgia, Dania, Hiszpania to kraje posiadające uregulowaną sytuację pokera online, a firmy pokerowe działają tam na zasadzie krajowych licencji.
Do tego możemy doliczyć Wielką Brytanię, gdzie poker online jest w pełni legalny, ale system licencyjny nie istnieje, chociaż jest w planach. Znaczna więc część Unii Europejskiej reguluje rynek hazardu online. Dwa kraje z najbardziej restrykcyjnym prawem dotyczącym gry w internecie to Portugalia i Polska. Pojawiły się jednak pierwsze plotki sugerujące, że na pozycjach strażnika i obrońcy obywateli pozostanie już tylko Polska.
Jak podaje strona recentpoker.com anonimowe źródło z portugalskiego ministerstwa ekonomii poinformowało iż prowadzone są prace nad zalegalizowaniem i uregulowaniem hazardu online również w Portugalii. Rząd portugalski spodziewa się, że wprowadzenie licencji pozwoliłoby jeszcze w 2012 roku wspomóc budżet kwotą około 250 milionów euro. Według informacji jakie podobno pojawiły się w wewnętrznym rządowym dokumencie pieniądze pozyskane z licencji miałyby pokryć zobowiązania państwa w związku z systemem ubezpieczeń społecznych.
Plany legalizacji gry online w Portugalii to na razie plotka, nie potwierdzona przez rząd w związku z tym nie ma żadnych szczegółowych informacji dotyczących tego jak taki system miałby wyglądać, jakie gry objąć, a także jak wyglądałyby kwestie podatkowe.
Portugalia to kraj kilkukrotnie mniejszy niż Polska można więc przyjąć dość spokojne założenie, że w przypadku legalizacji hazardu online w Polsce nasz rząd mógłby spodziewać się jeszcze większych wpływów do budżetu. (by pawcio z pokertaxas)

W Danii tak zamierzają ścigać e-firmy, które nie wykupią u nich licencji na e-hazard:

The Danish gambling market opened on January 1, 2012 and the Danish Gambling Authority has made it clear that it wants to keep illegal operators out. One of the actions it is taking is encouraging whistle blowing. In that respect it has published an advisory outlining what constitutes an illegal gambling website, the consequences of providing illegal gambling and how to report illegal operators. A dedicated e-mail address has been provided for this purpose and citizens and companies have been asked to file complaints enclosing documentation like screen dumps.
The advisory says that an online gambling website is illegal when it is directed towards the Danish market. Some indicators of this are that the web site is in Danish, it offers customer service in Danish, and accepts Danish currency. The following action will be taken against illegal online gambling operators. They will first receive a notice of contravention and of ceasing to provide illegal online gambling in Denmark. Then customers' access to the illegal website will be denied, transfer of funds will be blocked and the violation will be reported to the police
